Return to Work and Suitable Duties
Return to Work and Suitable Duties
Summary
Injured workers should return to work as soon as medically appropriate under an agreed plan.
Plans must align with the nominated treating doctor’s restrictions. Suitable duties may include parts of the pre‑injury role, reduced hours, different duties/sites, training, or combinations. Consider certificate restrictions, skills, residence, and usefulness to the employer’s business.
Referral or Escalation
Do a legal referral if duties are not offered/withdrawn, are demeaning/inappropriate, or where employer conduct unduly influences the plan.
Practical Tips
- Confirm restrictions from the Certificate of Capacity.
- Document offers and changes to duties.
