HSU members at Arcare Wright have reported that local management insist you must provide your personal medical reasons to access your personal leave entitlements.
Know your rights!
- You are not required to provide your private and confidential medical information when you notify of an absence
- Your health information is recognised as “sensitive information” under the Privacy Act
- You can tell your manager you are not comfortable providing details about your illness/injury and will ensure your return to work does not impact the health and safety of residents
What are you required to do?
Your Enterprise Agreement sets out your rights and obligations when taking personal leave.
- You must notify the Employer at least two hours prior to your normal starting time on the day of the absence
- You must also advise the period or, expected period, of the absence
- You may also be required to supply evidence to support your absence. Get more information on evidence HERE
