Personal Leave Evidence – RSL Lifecare

HSU members at Albert Moore Gardens recently received email communication from RSL Lifecare stating they must provide a medical certificate to access personal leave entitlements. This is only half of the story!
Your Enterprise Agreement (EA) clearly outlines that you may provide evidence that would satisfy a reasonable person that the leave was taken for a permissible reason or occasion.
This evidence may comprise of either:
- A medical certificate from a medical practitioner, or
- A statutory declaration made by the employee stating that the employee was, is, or will be unfit for work during the period because of a personal illness or injury.
A copy of a Commonwealth Statutory Declaration (stat dec) can be accessed
here. These must be signed in front of an authorised witness. A list of authorised witnesses is on the back of the stat dec and includes nurses, physiotherapists and pharmacists.
