HSU members at Scalabrini - The Village have raised concerns about receiving automatic messages stating a medical certificate is required for any single-day sick leave.
After raising this with management, the correct position has been clarified under clause 22.9 of your Enterprise Agreement. Here are the key points:
1. No Blanket Rule
Scalabrini cannot require a medical certificate for every single-day absence for all. It is an individual matter, and the EA only requires evidence in limited situations, such as:
Two or more consecutive sick days
Three single sick days in the last 12 months without evidence
Absences before or after another form of leave
Where the employer has reasonable grounds for concern
2. Payment of Sick Leave
If you called in sick and none of the above situations apply, you must be paid form your accrued personal leave even if you did not provide a medical certificate.
3. Next Steps
Management have now been requested to remove the blanket requirement and ensure compliance with the EA.
