Your Sick Leave Rights at Abrina Home

HSU members at Abrina Home have raised concerns about sick leave requirements. An outdated notice about medical certificates has now been removed by management. Here is what the EA actually says.
 

  • Evidence is not required for every absence. Under Clause 35.2, the employer can only require evidence for two or more consecutive days of absence, or for single-day absences where there is a pattern or excessive absenteeism. Normal single-day absences do not automatically require a certificate.
     
  • A statutory declaration is acceptable evidence. You do not have to see a doctor. A stat dec made by you stating you were unfit for work is valid under Clause 35.2(b) and carries the same legal weight as a medical certificate.
     
  • When evidence is required for carer's leave, a medical certificate for the person you cared for or a stat dec from you explaining the circumstances satisfies the requirement under Clause 35.3.
